Terms of Service

These Terms of Service ("Terms") govern your access to and use of Emplai (the "Service") provided by Emplai ("Emplai", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Emplai provides AI assistants that businesses configure to answer questions, book appointments, and follow up with their customers across web and messaging channels. Features and plans may change over time.

2. Accounts

You must provide accurate information and are responsible for safeguarding your account credentials and for all activity under your account. You must be at least 18 years old and able to form a binding contract.

3. Acceptable use

You agree not to use the Service to:

• break the law, infringe others' rights, or send spam or unlawful, harmful, or deceptive content;
• upload malware, attempt to breach security, or disrupt the Service;
• use the AI to provide regulated professional advice (legal, medical, financial) as if from a licensed professional; or
• reverse engineer, resell, or misuse the Service outside these Terms.

4. Subscriptions, billing, and refunds

Paid plans are billed on a recurring basis through Lemon Squeezy, our Merchant of Record, who handles the transaction and applicable taxes. Subscriptions renew automatically until cancelled. You can cancel at any time and your plan remains active until the end of the current billing period. Except where required by law, payments are non-refundable. Prices may change with notice.

5. Free trials

We may offer a free trial. Unless you cancel before the trial ends, your plan converts to a paid subscription at the then-current price.

6. Your content and customer data

You retain ownership of the content you upload and the customer data you process through the Service ("Your Content"). You grant us a limited license to host and process Your Content solely to provide and improve the Service. You are responsible for Your Content and for having the rights and permissions needed to use it, including any notices or consents required from your own customers.

7. AI outputs and no professional advice

AI-generated responses can be inaccurate, incomplete, or unsuitable for a given situation. You are responsible for reviewing outputs before relying on them. The Service does not provide legal, medical, financial, or other professional advice, and you should keep a human in control for important decisions.

8. Intellectual property

The Service, including its software, design, and trademarks, is owned by Emplai and protected by law. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service.

9. Third-party services

The Service integrates with third parties (for example AI providers, calendar, messaging, and payment providers). Your use of those integrations may be subject to their own terms, and we are not responsible for third-party services.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the maximum extent permitted by law, Emplai will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

12. Indemnification

You agree to indemnify and hold Emplai harmless from claims arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. Upon termination, your right to use the Service ends.

14. Governing law

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law rules, and the courts located in Pakistan will have jurisdiction, unless a mandatory local law provides otherwise.

15. Changes

We may update these Terms from time to time. If we make material changes, we will provide notice where required. Continuing to use the Service after changes take effect means you accept the updated Terms.
